Terms governing use of ApexStream Cloud and related services.

1. Agreement
These Terms & Conditions ("Terms") govern access to and use of the ApexStream website, dashboard, APIs, and managed cloud services (collectively, the "Services") operated by ApexStream ("we", "us", "our").
By creating an account, connecting to our WebSocket gateway, or otherwise using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
2. Services
ApexStream provides realtime infrastructure including WebSocket connectivity, channel pub/sub, control-plane APIs, metering, and related dashboard tooling. Features and limits depend on your plan.
We may modify, suspend, or discontinue features with reasonable notice when practicable. Beta or preview features may be offered as-is without SLA commitments.
3. Accounts & acceptable use
You are responsible for safeguarding API keys, credentials, and account access. Notify us promptly of suspected unauthorized use.
You must not use the Services to violate law, infringe others' rights, distribute malware, launch denial-of-service attacks, send unsolicited bulk messages, or attempt to bypass usage limits, isolation, or security controls.
4. Your content & data
You retain ownership of application data and messages transmitted through the Services. You grant us a limited license to host, process, and transmit that data solely to provide and improve the Services, comply with law, and enforce these Terms.
Our Privacy Policy describes how we handle personal data.
5. Plans, billing & taxes
Paid plans are billed in advance on a recurring basis unless otherwise stated. Usage-based components are measured according to published limits and dashboard metrics.
Fees are exclusive of applicable taxes unless stated otherwise. Failure to pay may result in suspension or termination of paid features.

6. Intellectual property
We own the Services, software, documentation, and branding. Open-source components remain under their respective licenses.
You may not reverse engineer the Services except where permitted by law. Feedback you provide may be used without restriction or compensation.
7. Disclaimers & limitation of liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100) IF YOU USE A FREE PLAN.
8. Termination
You may stop using the Services at any time. We may suspend or terminate access for material breach, non-payment, legal requirement, or risk to the platform.
Upon termination, your right to use the Services ends. Provisions that by nature should survive (including payment obligations, disclaimers, and liability limits) remain in effect.
9. Governing law & contact
These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction.
